These Terms of Service apply to all Nth Degree Labs products and services. If you were directed here from a specific product (such as smpl pomodoro), these terms govern your use of that product as well as all other Nth Degree Labs software and services.

1. Acceptance of Terms

By downloading, installing, or using any Nth Degree Labs application or service, you agree to be bound by these Terms of Service. If you do not agree, do not use our products.

2. Use of Our Services

Our products are provided for personal, non-commercial use unless otherwise stated. You agree to use our services only for lawful purposes and in accordance with these Terms.

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

3. Prohibited Conduct

You agree not to:

Reverse engineer, decompile, or disassemble our software
Use our services to transmit harmful, offensive, or unlawful content
Attempt to gain unauthorized access to any part of our systems
Resell, sublicense, or transfer access to our services without written permission
Use automated means to scrape, crawl, or extract data from our services

4. Intellectual Property

All content, design, code, and trademarks within Nth Degree Labs products are the property of Nth Degree Labs or its licensors. Nothing in these Terms grants you any right to use our brand, logos, or proprietary materials without prior written consent.

5. Third-Party Services

Some of our products integrate with third-party services (such as Google Drive and Google Sign-In). Your use of those services is governed by their respective terms and privacy policies. Nth Degree Labs is not responsible for the practices of third-party services.

6. Disclaimer of Warranties

Our services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that our services will be uninterrupted, error-free, or free of viruses or other harmful components.

7. Limitation of Liability

To the fullest extent permitted by law, Nth Degree Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our services—even if we have been advised of the possibility of such damages.

8. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date above. Continued use of our services after changes constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law provisions.
